Privacy Policy

Company’s Privacy Statement covers the collection, use, and disclosure of non-protected, non-medical, personal information that may be collected by Company anytime Subscriber interacts with Company, such as during visits to any of Company’s or Company’s supplier’s or subcontractor’s websites, when Subscriber purchases Company’s products or services, when Subscriber uses certain Company products or applications, or when Subscriber calls or emails Company’s support associates (collectively, Company’s “services”). Company only collects personal information about Subscriber if Subscriber voluntarily chooses to share it with Company. “Personal Information” includes personal identifying information such as name, address, telephone numbers, e-mail address, and payment or credit card information. When Subscriber interacts with Company’s support associates via email, telephone, or otherwise, Company may collect Personal Information relevant to the situation, such as Subscriber’s name, mailing address, phone number, email address, and contact preferences; information about the Company products Subscriber uses, such as their serial numbers and date of purchase; and information relating to the services. Company’s tracking equipment and services may collect information such as the location of the item or person being tracked, the equipment’s location and direction (‘Tracking Information”). Company or its contractors retain this Tracking Information on their servers. This Tracking Information regarding services performed for each Subscriber is linked to the Personal Information of that Subscriber. This Tracking Information may be aggregated on an anonymous basis with similar information from other users. This aggregated Tracking Information may be used by Company and shared with some of its third party suppliers to enhance the quality and accuracy of services. Subscribers may suspend the collection of Tracking Information by turning off the locator device that Company uses to provide the services. Subscribers may terminate the collection of Tracking Information by terminating this Agreement in accordance to section 8 of this Agreement. Company may share Personal Information, Tracking Information, and information collected from Company's or Company’s supplier’s or subcontractor’s websites with Company’s agents, corporate affiliates, or advisors who help Company operate and improve its business. Company has entered into agreements with its agents, corporate affiliates, and advisors to which it discloses non-protected, non-medical Personal Information, Tracking Information, and information collected from Company’s or Company’s supplier’s or subcontractor’s websites that requires them to adhere to pertinent provisions of this Privacy Statement. Subscriber understands that Company’s subcontractor(s) or supplier(s) may have different terms, conditions and privacy policies. For further information regarding this, please read any provided additional documentation or contact Company. Subscriber’s Personal Information will be retained for as long as Subscriber receives the services and for any period during which there is a dispute between Subscriber and Company. Tracking Information will be retained for each Subscriber for a period that Company will decide in its sole discretion. Except as specified above, Company will only share Subscriber’s non-protected, non-medical Personal Information with third parties if: (a) Company has Subscriber’s consent, (b) Company determines that it is must do so in order to comply with applicable laws, regulations or subpoena, (c) Company determines it would be appropriate to do so only in order to assist or support a third party's theft investigation involving Company’s locator equipment or a third party's theft prevention efforts relating to Company’s locator equipment, (d) Company finds that Subscriber is in breach of its terms and conditions or any of its policies or usage guidelines for specific products or services (e) it is necessary in Company’s opinion to do so to prevent, investigate, detect or prosecute criminal offenses or attacks on the technical integrity of Company’s site(s) or Company’s supplier’s or subcontractors site(s) or Company’s network (f) it is necessary in Company’s opinion to do so to protect the rights, property, or safety of Company or its employees, the users of its website(s), or the public ; or (g) it is necessary to fulfill Subscriber’s product or service order. Company may use an outside shipping company to fulfill Subscriber’s order, and a credit card and/or ACH processing company to process Subscriber’s credit card and/or ACH information as required for Subscriber’s order and to ensure that Subscriber’s transaction is secure. These companies do not retain, share, store or use Subscriber’s personally identifiable information for any other purposes. Additionally, Company may disclose or sell Personal Information and information collected from the aforementioned web sites as an asset in conjunction with the sale of Company to a third party or in conjunction with the sale of a portion of Company's assets, or a merger. Company restricts access to Personal Information to Company employees, contractors and agents who need to know that information in order to operate, develop or improve the services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. However, Company cannot guarantee the security of any Personal Information or Tracking Information, or information collected from the aforementioned websites. Despite Company’s efforts to secure such information, it may be accessed, disclosed, altered, or destroyed by a breach of Company’s physical, technical, and procedural safeguards. Subscriber uses the services and visitors use the aforementioned websites at their own risk. If Company learns that Subscriber’s Personal Information or Tracking Information has been disclosed to an unauthorized person, Company will use reasonable efforts to attempt to notify Subscriber. While Company continues to work hard to protect Subscriber’s Personal Information, no data transmission over the Internet can be guaranteed to be 100 percent secure and Company cannot ensure or warrant the security of any information Subscriber transmits to the aforementioned websites over the Internet. Subscriber transmits personal information over the Internet at his or her own risk. This Privacy Statement addresses only the policy and procedures of Company. Company is not responsible for the privacy policies of third parties, including but not limited to those whose web sites that may be linked to Company websites and/or Company’s supplier’s or subcontractor’s web sites. Subscriber hereby acknowledges that all communications between the Subscriber, Company and the central station may be recorded and Subscriber consents to such recording. 5. FAILED RESPONSE: Company shall not be responsible for losses or damages suffered by Subscriber caused by delay in response time or failure to respond by any person or authority notified by Company according to Subscriber’s instructions. 6. STARTING, INTERRUPTION AND STOPPING OF SERVICE: Many governmental jurisdictions have waiting periods from time of installation before a call can be made for police, emergency personnel or other services that may relate to Subscriber’s service. Company is bound by all laws that may pertain to the installation of any equipment or service for calls to police, emergency personnel, other authorities or other individuals. Subscriber understands and agrees that monitoring may not begin and equipment may not be activated until the end of two business days after the equipment is installed. Furthermore, Subscriber acknowledges that the activation of equipment and the start of service will not begin until: (1) Subscriber tests Subscriber’s equipment and/or system, (2) a test signal is successfully received by the central station, (3) Subscriber receives confirmation that such signal was received and (4) the Subscriber agreement is signed by the Subscriber or an eligible signer or Subscriber begins authorized use of the equipment or service, constituting acceptance of this Agreement. Company may decline to activate services if (a) Subscriber fails to provide all applicable information on the Subscriber Information Form (b) Company determines that SIM cards, in which some equipment contain, has been or will be used improperly or (c) Company determines in Company’s sole discretion that Subscriber will use the equipment or service in a manner that will violate this Agreement. Company may immediately terminate this Agreement at any time, and deny Subscriber access to or use of services, including without limitation, in the event Subscriber breaches this Agreement or engages in conduct that Company, in Company’s sole discretion, considers unacceptable. Company will notify Subscriber of this termination according to the manner detailed in section 15. Subscriber may terminate this Agreement at any time subject to the terms and conditions in section 8. Subscriber understands that Company assumes no liability for interruption or stoppage of monitoring service and any other services due to strikes, riots, severe weather, floods, storms, earthquakes, fires, power failures, interruption or unavailability of cellular network, radio towers, GSM network, wireless internet network, GPS network, tracking and telephone service, acts of God, Company being unable to subcontract for central station monitoring service 24 hours a day, 7 days a week or any other cause or such severe damages to Subscriber’s premises that continuing service would be impractical. Furthermore, Subscriber acknowledges that Company may stop or suspend monitoring services or any other services to the Subscriber due to any such cause. Additionally, Company may stop or suspend monitoring service or any other services if Company is unable to provide such services because of some action or ruling by any government authority.
